Oral hearing denied in Wells Sherman House case

A Portage County Common Pleas judge rejected Save the Standing Rock Garden’s motion for an oral hearing in the ongoing court case concerning the relocation of the Kent Wells Sherman House.

Judge John Enlow’s verdict is the result of an objection filed by Save the Standing Rock Garden’s attorney John Plough, which argued Portage County magistrate Kent Graham made an error by denying a preliminary injunction request.

The preliminary injunction request would have stopped the relocation of the Wells Sherman house to 247 N. Water Street. Following the denial of the request, Plough asked the court for an oral hearing to present more information.

“In reviewing Plaintiffs’ objections the Court concludes that the Magistrate has properly determined the factual issues and appropriately applied law,” Enlow said in his order. “Therefore, notwithstanding said objections, the Court adopts the Magistrate decision and its conclusions, findings and recommendations as the Court’s own.”

As the trial continues, the Wells Sherman House remains at its temporary location on East College Avenue.
